This Privacy Policy (the “Policy”) applies to Credenti LLC. and its subsidiaries.
References to “we”, “us” or “Credenti” in this Policy mean Credenti LLC., and its subsidiaries, as far as they are related to the operation of the Websites, Portals, Products or the Services (collectively the “System”) or as otherwise relevant under this Policy.
References to “you” or “your” mean the individual who has or may in the future enter into a relationship with Credenti as a user of our System.
Credenti is dedicated to providing informative and useful information about its products and services through web, mobile, and other software and related systems and platforms, as well as any in-person, telephone, or other offline locations or through other aspects of Credenti business, including, without limitation, on and through the websites located at www.credenti.com and/or other portion of the System designated by Credenti from time to time. As a part of the operation of the System, Credenti gathers certain data about users depending upon how you use Credenti System in your geographical location.
This Privacy Policy (the “Policy”) applies to the System and governs data collection and usage at, on, and through the System.
Please read this Policy carefully. Each time you use, browse, or otherwise access any part of the System, you signify your acceptance of the then-current Policy, including, without limitation, the then current terms found elsewhere on the System. If you do not agree with this Policy, you are not authorized to access or otherwise use the website, mobile application, desktop application or any other part of our Systems, or purchase any products from Credenti™ directly or via our partner channel.

Our Privacy Principles

We follow the following principles regarding Credenti data processing activities:

  1. We strive to process Personal Data in a reliable and confidential way. Each person’s right to the protection of their Personal Data is important to us and we shall do our best to ensure that Personal Data collected by us is adequately protected. We will put our best efforts to regularly evaluate the risks associated with the processing of Personal Data and apply appropriate mitigation strategies to hedge risks.
  2. Data protection is an integral part of our Service. Privacy comes first in everything we do. We care about developing and deploying products & services that take into account privacy from the outset, rather than as an afterthought or add-on. Compliance with our Privacy Notice is integrated into our day-to-day activities, services and processes, and our development efforts. We understand that compliance with data protection rules takes place through our employees. Therefore, we consider it important and we seek to ensure that our employees know and comply with the requirements thereof. We expect, instruct and train our employees to respect our privacy requirements. We process Personal Data lawfully and purposefully. We set clear goals for the processing of Personal Data and process Personal Data for these purposes only. We refrain from collecting or processing the data that we do not need. Credenti aims to delete/blur or make in other ways unreadable any data or documents presented in the session that are not necessary for provision of the services. This also means all transfers of Personal Data must have a valid legal basis.
  3. We process Personal Data in a transparent and fair way. We strive for an appropriate, secure, honest and lawful manner of processing the Personal Data to prevent the unauthorized disclosure or inappropriate use of Personal Data. We also work to eliminate the possibility of discrimination or bias in our Service.
  4. We store Personal Data only for as long as the retention of data is required by law, a contract or is necessary for the provision of our Services or required for protecting us against legal claims. At the end of the retention period, we shall permanently erase the Personal Data or anonymize it.
  5. We do our best to make sure that the Personal Data we process is limited to what is necessary for the purpose for which it was collected.

Types of Data Collected

This Privacy Policy applies to the processing of Personal Data that we collect in the following ways, as detailed in this section.

We collect information about you when you provide it to us, when you interact with our products and services, websites and electronic systems, when you attend events and visit our offices, and when other sources provide it to us, as further described below.

Based on our current practices , we collect the following categories of information about you:

Enterprise Products: If you use enterprise products made available by Credenti, then we may receive various types of information and content from you that you choose to share, including contact information (such as your first and last name, email address, and phone number), additional multi-factor authentication factor setup details, content you upload (such as identification or other documentation, if applicable),if applicable, photos and videos as well as data, such as face scans, fingerprint scan and other measurements, extracted from the same which are used to authenticate the end-user or compare the end-user’s face to identity document photos – some of this extracted data may be considered biometric data and/or sensitive Personal Data (also “special category of personal data”, hereinafter referred to as “sensitive Personal Data”) under applicable data protection laws in certain jurisdictions; , and information regarding the websites and applications that you visit and use through our Products for authentication. We also receive Ancillary Data, including device data, unique device identifier, time zone, machine-readable data, metadata, IP address and network information.

Administrator Data: When we setup an account for you to try our Products, subscribe to any Service via another entity (such as a marketplace or authorized reseller), have the ability to submit a support request, or are designated an administrator of any part of the Service, then information is provided to us about you (“Administrator Data”). Administrator Data usually includes your name, email address, phone number, address, billing information, business contact information, credentials information, subscription and service configurations you select, and other details you may provide to us about you or include in your profiles in our admin portals. We may also receive any Personal Data you share via tooling used to provide support, e.g., videoconferencing or other communication methods you participate in.

Contact and Professional Data: We collect contact and/or professional data about you in person, through communications, including communications from you or your colleagues, and through our websites. For example, you provide your contact and professional information to us when you sign up to learn more about Products and Services, download content, register for an event, and visit our offices. If you attend an event, we may also receive contact and professional details about you when you choose to scan your attendee badge or by providing a business card or other method(s) whereby you share Personal Data with us. Typically, contact data includes your name and contact methods, such as telephone number, email address, and office or other mailing address, and professional data includes details such as the organization you are affiliated with, your job title, and industry.

Biographical, Community, and Support Data: We may also collect various types of biographical, community, and support Personal Data from you via our help center and community support forums. For example, if you register for an online community that we host, we may ask you to provide a username, photo and/or biographical information, such as your occupation, organization name and areas of expertise. Additionally, you may provide Personal Data to us when you create user-generated content (for example, by posting in a forum), provide Credenti with feedback, or when you participate in interactive features, training, online surveys, contests, promotions, sweepstakes, activities, or events. Credenti may receive Personal Data and Administrator Data in connection with an administrator’s request for support for the Credenti service.

Job Applicant Data: We collect contact and professional information, including your resume with educational and work background, that you provide when you apply for a job with Credenti. We may also collect sensitive information, like your Social Security Number or other government identifier, criminal history information, employment history, racial or ethnic origin, or other such Personal Data that you provide in connection with your job application.

Contract Data: We may receive contract details (like signatures) from you or your organization Personal Data such as name and billing address, in connection with some of our Products and Services.

Audio, Electronic, or Visual Data: If you attend our in-person or virtual event or agree to be recorded in a telephone or video meeting, we may record some or all of that event or meeting. For events, we may document the event in various ways, such as by taking photos at the event, interviewing you at the event, or recording your participation in a live question-and-answer or other interactive session. We use this information for business and marketing purposes to better inform the public about Credenti , its events, and provide testimonials about our products and services, to the extent permitted by applicable law.

Depending on your jurisdiction, if we collect sensitive data from you, we will do so by providing you with additional notice or confirming your consent upon collection, if required by applicable law.

Collection and Usage

Personal Data is gathered when users provide or authorize Personal Data to or through the System, for example, when requesting information, participating in an online survey, inputting content into the System, verifying user credentials, badge or biometric enrollment, purchasing products or services, allowing access to social media networks, or utilizing any other our products or services through the System.

Digital Onboarding and Identity Proofing ensures user’s claimed identity matches their actual identity (who they actually are) and for this we capture selfie of the verification session as well as data extracted from the same, such as face scans and other measurements (such extracted data may be biometric data and/or sensitive Personal Data in certain jurisdictions), and the document(s) provided for verification. In addition, for verification, we conduct fraud prevention and detection checks that are an integral part of our Service. 

Traffic Data is tracked and gathered when you and other users visit or access the System. While gathering Traffic Data may not collect Personal Data, it may provide information on the geographical location from which users access the System. Traffic Data generally does not identify individual users. Instead, the Traffic Data identifies System users as a whole, including demographic information, preferences in content and advertising, quality of service, and web and application traffic patterns.

Credenti may, in its sole and absolute discretion, release and disclose the Collected Data to affiliated or contracted persons, associations, resellers and channel partners or other entities of whatsoever nature, including, without limitation, strategic alliances and advertising affiliated persons and/or entities (the “Related Parties”) or to any law enforcement agency, court, or other governmental authority to: (a) help Credenti respond to your requests for information, goods or services and/or otherwise fulfill a user’s lawful request; (b) respond or otherwise comply with subpoenas, court orders, or other edicts of the law or legal process; (c) protect and defend Credenti rights and property; or (d) to protect the personal safety of Credenti users, Credenti employees, or the public.

For instance, Credenti may use your Personal Data to: 

  1. Send you information about Credenti™ and its products, updates, services, important notices, special offers, and/or upcoming promotions; 
  2. Send you information about the Related Party’s Products and Services; 
  3. Conduct surveys about your opinion of Credenti, its staff, performance, Products and Services or the System; 
  4. Verify your qualifications for certain promotions, special offers, products and services; 
  5. Bill you for any Products and Services purchased through the System via, electronic, or other payment; 
  6. Customize, improve, and/or tailor your experience on the System by displaying content that Credenti thinks you might be interested in according to your preferences.

Where appropriate, in Credenti sole and absolute discretion, Credenti may provide notice to you. For example, Credenti believes it may be necessary to share information with or without notice in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of the website terms of use, or as otherwise required by law.

Credenti may, in its sole and absolute discretion, release and disclose the Collected Data to any persons, associations, or other entities of whatsoever nature not affiliated with Credenti (the “Non-Affiliates”) for the purpose of facilitating your instructions, requests and/or registrations for products or services provided by Credenti  or the Non-Affiliates (including, without limitation, customer support, information technology support,  electronic payment processing and personal profile services) when the transfer of such Collected Data is necessary to provide you with such Products or Services. By selecting, instructing, requesting, reserving and/or registering for such Products or Services from Credenti  or the Non-Affiliates on or through the System, you consent to the release of your Collected Data to the Non-Affiliates. Credenti shall use reasonable efforts to provide the Non-Affiliates access only to the Personal Data necessary to assist in responding to your instructions, requests, and/or registrations for such products or services and cause such Non-Affiliates to use your Personal Data for these limited purposes.

Credenti may also disclose, release, transfer, or otherwise convey any Collected Data to prospective or actual buyers, or persons and/or entities related to such actions by Credenti, including, without limitation, Credenti may transfer information about you if Credenti is acquired by or merge with, or otherwise divest any portion of its assets or equity to any other company.

You consent to any and all such conveyances of the Collected Data regardless of your location and your consent includes any and all such conveyances outside of your location, including, without limitation, in the United States and in other countries and territories.

Your Rights

Under certain circumstances, you have the rights under data protection laws in relation to your Personal Data. These include the right to:

  • Request access to your Personal Data.
  • Request correction of your Personal Data.
  • Request erasure of your Personal Data.
  • Object to processing of your Personal Data.
  • Request restriction of processing your Personal Data.
  • Request transfer of your Personal Data.
  • Right to withdraw consent.

If you wish to exercise any of the rights set out above, please email us at privacy@credenti.com  We may need to request specific information from you to help us confirm your identity and ensure your right to access your Personal Data (or to exercise any of your other rights). This is a security measure to ensure that Personal Data is not disclosed to any person who has no right to receive it. We may also contact you to ask for further information in relation to your request to speed up our response.

California and Delaware “Do Not Track” Disclosures

California and Delaware law require Credenti to indicate whether it honors “Do Not Track” settings in your browser concerning targeted advertising. Credenti adheres to the standards set forth in this Policy and does not monitor or respond to Do Not Track browser requests because there currently isn’t an industry or legal standard for recognizing or honoring them.

Opt Out

From time to time, you may receive periodic mailings, telephone calls or emails from Credenti with news or other information on Credenti Products and/or Services. If at any time you wish to stop receiving emails or mailings, please send us an email to  privacy@credenti.com with the phrase “Privacy Opt-out: Credenti, Mailings” in the subject line, or write to us at 5177 Richmond Ave, STE 1160, Houston, TX 77056, and we will process your opt-out request. Alternatively, for email communications, you may opt out of receiving such communications by following the unsubscribe instructions set forth at the bottom of most e-mail messages from Credenti.

If you wish to exercise rights you may have under the California Consumer Privacy Act, or other similar laws which may apply to you, to have your information opted-out of the sale of Collected Data by Credenti, or to request the deletion of your information from the Collected Data, please send us an email to privacy@credenti.com with the phrase “Privacy Opt-out: Credenti, Notice of Opt-Out” in the subject line, or write to us at 5177 Richmond Ave, STE 1160, Houston, TX 77056, and we will process your opt-out request. In processing your request, Credenti™ reserves all obligations and rights it has to maintain your information as necessary for compliance with the laws of the jurisdictions in which it operates.

In the event that Credenti wishes to transfer or release your Personal Data to a third party in a manner not set forth in this Policy, Credenti shall inform you prior to such transfer or release and provide you with the ability to opt out of such transfer or release of Personal Data. Please contact Credenti at privacy@credenti.com if you have any questions as to how to opt out of any specific disclosures, or any marketing or other programs.

Cookies and Related Files

Credenti, through the System, may place small files, called ‘cookies’ onto your computer or electronic device, as well as related files, such as web beacons, pixel tags, or other means. Credenti may use such files or Internet protocol addresses for a number of reasons, such as record keeping purposes when you visit Credenti websites, identifying you as a unique user, simplifying the process of recording personal information (such as enabling users to not have to enter names, addresses or passwords repetitively), allowing Credenti to better understand how users use the System and help Credenti tailor the System or marketing message to better match needs and interests.

You may be able to program your browser to not accept cookies or other files, but if you do, you may be unable to access some parts of the System or some parts of the System may not work properly.

While on the System, you may receive cookies from third party advertisers or promotional entities. These cookies are outside the control of Credenti, are not subject to the Policy, and Credenti is not responsible for such third-party cookies.

Links to Third-Party Sites

The System may contain links to other websites or media not operated or controlled by Credenti. These links are provided as a convenience to the visitors of the System. Since Credenti does not operate or control linked websites or media, Credenti cannot be responsible for the personal information collection and use policies of such linked websites or media. Therefore, you should review the privacy policy of linked websites or media prior use to use or giving personal information.

For example, chat rooms, forums, message boards, links to third party websites or mobile applications (including social media websites and mobile applications), and/or news groups may be available through the System. While Credenti will only use and disclose the Collected Data as set forth herein, any information disclosed in these areas is or may be deemed public information and you must exercise caution and discretion when deciding to disclose personal and non-personal information.

Additionally, please keep in mind that if you directly disclose Personal Data or personally sensitive data through your home page, linked sites, or other public forums, this information may be collected and used by others. Credenti encourages all users to review the privacy statements of websites and/or mobile applications you choose to link to from the System so that you understand how those third parties collect, use and share information about you and/or your electronic devices. Credenti is not responsible for the data collection, data usage, privacy statements or content on other websites, applications or other solutions.

Measures to Safeguard Children

Credenti  Products and Services are not directed or intended for the use of children or users under the age of 18. Credenti  encourages parents and guardians to spend time with their children online and to be fully familiar with the websites and other software visited by their children. Credenti  does not knowingly collect or maintain personal information from children under 18 years of age. If Credenti learns that Personal Data of a child under 18 years of age has been collected, Credenti will take steps to delete the information as soon as possible. If you are under 18 years of age or the proper legal age, you are not allowed to use or access the System at any time or in any manner and any such use is unauthorized.

However, no security system is perfect, and due to the inherent nature of the Internet, we cannot guarantee that data, including Personal Data, is absolutely safe from intrusion,alteration, disclosure and/or other impermissible uses and Credenti  is not responsible for such unauthorized access or other impermissible uses by others. You are responsible for protecting your password(s) and other authentication factors, as well as maintaining the security of your devices.

EU-US and Swiss-US Data Privacy Framework

We comply with the EU-US and Swiss-US Data Privacy Frameworks (DPF) and the UK Extension to the EU-U.S. DPF as set forth by the US Department of Commerce regarding the collection, use and retention of personal information from the EEA, Switzerland and the UK, respectively.

Credenti adheres to the Department of Commerce Data Privacy Framework Principles and remains responsible for any of your personal information that is shared under the Onward Transfer Principle with third parties for external processing on our behalf, as described in the “Collection and Usage” section of our Privacy Policy.

If you have any inquiries or complaints about our handling of your personal information under the Data Privacy Framework, or about our privacy practices generally, please contact us at: privacy@credenti.com. We will respond to your inquiry promptly. If dispute resolution does not resolve your complaint, you may pursue binding arbitration through the Data Privacy Framework Panel.

Changes to this Policy

Credenti and its subsidiaries reserves the right to change or modify this Policy, including, without limitation, to reflect company and user feedback or changes in applicable law. Please revisit this Policy from time to time for changes and updates. If Credenti refuses access to you, Credenti™ may provide you with the reasons for such refusal upon request; provided, however, that Credenti reserves the right to refuse to give a reason for such refusal, including, without limitation, where such information contains references to other individuals, such information cannot be disclosed for legal, security or commercial reasons, or the information is subject to attorney-client or litigation privilege. Your continued use of the System constitutes your consent to any and all such changes.

Governing Law/Claims

This Policy, the System, and any claim associated with, related to, or arising from the Policy and/or System are governed by the law of the State of Texas within the United States. Any claim associated with, relating to or arising from this Policy or the System shall be brought in a federal or state court in Harris County, Texas within one year after the claim arises. You hereby affirm your consent to the sole and exclusive jurisdiction of the courts located in Harris County, State of Texas as the most convenient and appropriate forum for the resolution of disputes concerning this Policy or System. The System is controlled, operated and administered entirely within the United States. Use of the System from locations outside the United States where these practices are illegal or violate any law is prohibited.

System Provided "As Is" and Other Disclaimers

YOU AGREE THAT THE SYSTEM AND ALL CREDENTI PRODUCTS AND SERVICES ARE PROVIDED “AS IS.” CREDENTI MAKES NO REPRESENTATIONS, WARRANTIES, OR CONDITIONS OF ANY KIND, EXPRESS OR IMPLIED AND DISCLAIMS ANY AND ALL WARRANTIES, CONDITIONS OR REPRESENTATIONS, WHETHER OR NOT IMPLIED, ORAL OR WRITTEN, WITH RESPECT TO THE CREDENTI SERVICES, AND PRODUCTS, SYSTEM, OR ANY OF THE TRANSACTIONS REASONABLY CONTEMPLATED BY THE PARTIES PURSUANT TO THIS AGREEMENT INCLUDING, WITHOUT LIMITATION, ANY AND ALL IMPLIED WARRANTIES OR CONDITIONS OF TITLE, NON INFRINGEMENT, MERCHANTABILITY, FITNESS OR SUITABILITY FOR ANY PURPOSE (WHETHER OR NOT CREDENTI™ KNOWS, HAS REASON TO KNOW, HAS BEEN ADVISED OR IS OTHERWISE, IN FACT, AWARE OF ANY SUCH PURPOSE, WHETHER ALLEGED TO ARISE BY LAW, BY REASON OF CUSTOMER USAGE IN THE TRADE OR BY COURSE OF DEALING

CREDENTI AND ITS REPRESENTATIVES SHALL NOT BE LIABLE TO YOU (OR TO ANY PERSON CLAIMING ANY RIGHT, TITLE OR INTEREST DERIVED FROM OR AS SUCCESSOR TO YOUR RIGHT, TITLE AND INTEREST) WHETHER IN TORT (INCLUDING NEGLIGENCE), CONTRACT OR OTHER LEGAL THEORY FOR INCIDENTAL, INDIRECT, CONSEQUENTIAL OR SPECIAL DAMAGES OF ANY KIND INCLUDING, WITHOUT LIMITATION, LOST REVENUES OR PROFITS, LOSS OF BUSINESS, LOSS OR CORRUPTION OF CONTENT, INTERRUPTION OR COMPUTER FAILURE ARISING OUT OF THIS AGREEMENT, IRRESPECTIVE OF WHETHER THE PARTIES HAVE ADVANCE NOTICE OF THE POSSIBILITY OF SUCH DAMAGES.
